Our courses are created by selected instructors who work with us under individual agreements, and are designed for art enthusiasts, hobbyists, and complete beginners worldwide. The Site enables users to access and purchase video courses, tutorials, and related educational materials (collectively, the 'Services').
These Terms of Use govern your access to and use of the Services, whether as a visitor or a registered user. Please read them carefully before using the Site. 4. INTELLECTUAL PROPERTY
All course content, videos, materials, images, written guides, and related assets delivered through the Site are the intellectual property of Texturely Studio. This includes content created by instructors working with us — all such content is owned by Texturely Studio under the terms of our individual agreements with each instructor. Instructors are compensated separately for their contributions and do not retain ownership of content once it is delivered to us.
By purchasing a course, you receive a limited, personal, non-exclusive, non-transferable licence to access and view that course for your own personal, non-commercial use via the Site on a streaming basis. No other rights are granted. You must not download, record, screenshot, reproduce, share, or redistribute any course content without our express written permission.
The Texturely Studio name, logo, and all related brand assets are our property. You must not use them without our prior written consent.
If you believe content on our Site infringes your copyright, please contact us at support@texturelystudio.com with the following:
• Identification of the copyrighted work you believe has been infringed
• The URL or description of the infringing material on our Site
• Your name and contact details
• A statement that you have a good faith belief that the use is not authorised by the copyright owner
• A statement that the information in your notice is accurate
We will review all valid complaints and take appropriate action, which may include removing the relevant content.
5. FEES AND PAYMENT
Texturely Studio offers courses for a fee. Prices are displayed on the relevant sales page and are subject to change. By completing a purchase, you authorise us to charge your selected payment method for the applicable fee.
You are responsible for providing accurate and current payment information. Prices are displayed in the currency shown at checkout. Due to exchange rate fluctuations, the final amount charged may vary slightly from the displayed price depending on your location and payment provider.
We may run limited-time promotions or discounts at our discretion. The price applicable to your purchase is the price at the time you complete your transaction. Promotional pricing does not apply retroactively to previous purchases.
Our standard refund policy is a 30-day money-back guarantee. If you are not satisfied with your course for any reason, you may request a full refund within 30 days of the purchase date by contacting us at support@texturelystudio.com.
Important: Refund terms may vary by course. Each course's specific refund conditions are stated on its individual sales page. Where a sales page specifies different terms, those terms apply and take precedence over this general policy. Please review the sales page for the relevant course before purchasing.
Regardless of the above, refunds will not be available in the following circumstances:
• Your account has been found to violate these Terms of Use
• We determine you are abusing the refund policy (e.g. repeatedly purchasing and refunding courses)
• Your payment method does not support refunds or your card has been blocked or deactivated
• You have deleted your account prior to requesting a refund
• The request is submitted after the applicable refund window has closed
We do not offer partial refunds. If you purchased through a third-party marketplace or app store, their refund policy will apply and we may not be able to process refunds directly.
Texturely Studio intends to offer membership and subscription plans in the future, which may provide access to multiple courses, exclusive content, and other benefits on a recurring basis.
If and when subscription or membership plans are introduced, your continued use of those features will constitute acceptance of the additional terms that apply to them.
The Services are provided on an 'as is' and 'as available' basis, without warranties of any kind, either express or implied. We do not guarantee that the Site will be uninterrupted, error-free, or free from harmful components.
Our courses are designed to teach creative techniques and skills. However, we do not warrant that any specific result, level of skill, or outcome will be achieved by any individual student. Results will vary depending on individual effort, prior experience, and personal circumstances.
To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by Malaysian law and applicable international law, Texturely Studio and its instructors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services — including but not limited to loss of data, revenue, or goodwill.
Our total liability to you for any claim arising from these Terms or your use of the Services will not exceed the total amount you paid us in the six (6) months preceding the claim, or USD 100, whichever is greater.
Nothing in these Terms limits our liability for fraud, wilful misconduct, or any other liability that cannot be excluded under applicable law.
You agree to indemnify, defend, and hold harmless Texturely Studio and its instructors, employees, agents, and affiliates from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Services.
These Terms of Use are governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.
In the event of any dispute arising from or in connection with these Terms or the Services, both parties agree to first attempt to resolve the matter informally by contacting us at support@texturelystudio.com. If the dispute cannot be resolved within 30 days of written notice, it shall be submitted to the exclusive jurisdiction of the courts of Malaysia.
Nothing in this section prevents either party from seeking urgent injunctive or equitable relief from a court of competent jurisdiction where necessary to protect intellectual property rights or confidential information.
We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive activity, or for any other reason at our reasonable discretion.
Upon termination, your licence to access any course content will cease immediately. Refunds following termination will be assessed in accordance with the Refund Policy in Section 6.
These Terms of Use, together with our Privacy Policy and any course-specific terms stated on individual sales pages, constitute the entire agreement between you and Texturely Studio with respect to the Services.
If any provision of these Terms is found to be invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable. The remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely without restriction.
These Terms are written in English. In the event of any conflict between this English version and any translation, the English version will prevail.
